Please read these Terms and Services ("Terms", "Terms and Services") carefully before using the Wellew mobile application and website (the "Service") operated by Well Goods, LLC. ("us", "we", or "our"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
1. Acceptance of Terms
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service. This is a legally binding agreement.
2. Description of Service
Wellew is a "freemium" health and nutrition tracking application. Free and premium features include, but are not limited to, food logging (via search, barcode, and AI photo analysis), an AI digital coach, analytics, personalized recipes, and the ability to share data with linked accounts or real-life (IRL) coaches.
Accuracy & Third-Party Data: The Service uses artificial intelligence and third-party databases (such as OpenFoodFacts) to estimate nutritional information. All nutritional data, AI analyses, and weight trajectory predictions are approximations for informational purposes only. Wellew does not guarantee their accuracy.
Shared Accounts: If you log data on behalf of another person (via linked accounts) or share your data with an IRL coach, you represent that you have their explicit consent to do so. Wellew is not responsible for how third parties use your data.
Service Availability: The Service utilizes both cloud synchronization and local device storage. It is provided strictly on an "as is" basis, and we assume no responsibility for syncing failures or the loss of offline tracking logs or user data.
3. User Accounts
When you create an account with us, you guarantee that you are above the age of 13, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
You are responsible for maintaining the confidentiality of your account and password, and you agree to accept responsibility for all activities that occur under your account or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Well Goods, LLC. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Well Goods, LLC.
5. Termination
We may terminate or suspend your account immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms.
You may terminate your account at any time from within the application's settings or by contacting our support team. Please note: Simply deleting the Wellew application from your device does not cancel any active paid subscriptions.
Upon termination, your right to use the Service will immediately cease. You will lose access to your tracked data, and any connections to linked accounts or IRL coaches will be severed. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
6. Disclaimers and Limitation of Liability
The Service is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease. Always seek the advice of a qualified health provider with any questions you may have regarding a medical condition. Wellew is not responsible for any health problems that may result from training programs, consultations, products, or events you learn about through the Service.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. In no event shall Well Goods, LLC., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
