1. Acceptance of Terms

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service. This is a legally binding agreement.

2. Description of Service

Wellew is a "freemium" health and nutrition tracking application. Free and premium features include, but are not limited to, food logging (via search, barcode, and AI photo analysis), an AI digital coach, analytics, personalized recipes, and the ability to share data with linked accounts or real-life (IRL) coaches.

Accuracy & Third-Party Data: The Service uses artificial intelligence and third-party databases (such as OpenFoodFacts) to estimate nutritional information. All nutritional data, AI analyses, and weight trajectory predictions are approximations for informational purposes only. Wellew does not guarantee their accuracy.

Shared Accounts: If you log data on behalf of another person (via linked accounts) or share your data with an IRL coach, you represent that you have their explicit consent to do so. Wellew is not responsible for how third parties use your data.

Service Availability: The Service utilizes both cloud synchronization and local device storage. It is provided strictly on an "as is" basis, and we assume no responsibility for syncing failures or the loss of offline tracking logs or user data.

3. User Accounts

You must be at least 13 years of age to create an account and use the Service. By creating an account, you represent and warrant that you are 13 or older, and that the information you provide us is accurate, complete, and current at all times. Inaccurate or obsolete information may result in the immediate termination of your account.

You are responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Well Goods, LLC. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Well Goods, LLC.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms.

You may terminate your account at any time from within the application's settings or by contacting our support team. Please note: If you purchase a premium subscription through a third party (such as the Apple App Store or Google Play Store), simply deleting the Wellew application from your device does not cancel your subscription. You must manage your billing and cancellations directly through your device's app store settings.

Upon termination, your right to use the Service will immediately cease. You will lose access to your tracked data, and any connections to linked family accounts or IRL coaches will be severed. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

6. Medical Disclaimer and Limitation of Liability

Not Medical Advice: The Service is designed for nutritional tracking and informational purposes only. It is not a medical device, nor is it intended to diagnose, treat, cure, or prevent any disease. Always seek the advice of a physician or other qualified health provider with any questions you may have regarding a medical condition or major dietary changes.

Shared Data and Coaches: Wellew includes social features such as "Family Share" and the ability to link your account with real-life (IRL) coaches. Well Goods, LLC. is not a party to those external relationships. We do not endorse, monitor, or take responsibility for any advice, meal plans, or feedback provided to you by family members or third-party coaches. You choose to share your data at your own risk.

Limitation of Liability: Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. In no event shall Well Goods, LLC., its directors, employees, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, personal injury, loss of profits, data loss, or other intangible losses resulting from your use of the Service.
